Welcome to Attune. These Terms of Use govern your use of the Attune mobile application and related services.
By using Attune, you agree to these Terms.
1. About Attune
Attune is an audio-first listening product that helps users discover short-form audio content based on what they are looking for in the moment.
Attune is currently in initial release. Features, content, recommendations, and availability may change.
2. Personal Use
Attune is provided for your personal, non-commercial use. You may not copy, resell, reverse engineer, misuse, or interfere with the app or its services.
3. No Professional Advice
Content in Attune may include information related to news, wellness, motivation, education, entertainment, sports, or other topics.
Attune does not provide medical, legal, financial, psychological, or other professional advice. You should not rely on Attune as a substitute for advice from qualified professionals.
4. Content
Attune may include audio content, titles, creator names, descriptions, and related metadata from third-party sources.
Attune presents audio content sourced from publicly available podcast publications and other authorized content sources. We may use publicly available metadata, transcript information, and machine learning to organize, classify, and recommend content to users. Attune is designed to help users discover creators and long-form audio through short audio excerpts, attribution, and links to original publications where available.
We do not guarantee that all content will be accurate, complete, available, or suitable for every user. Content recommendations and excerpts are provided to facilitate discovery of creators and long-form audio content. We are not responsible for the accuracy, completeness, or reliability of third-party content made available through the app.
If you believe content made available through Attune infringes your copyright or other intellectual property rights, please contact us at support@listentoattune.com so we can promptly investigate and, where appropriate, remove or disable access to the content.
5. Saved Clips and Listening History
Attune may allow you to save clips, resume listening, and view recently played content. During initial release, some data may be stored locally on your device or in our backend systems. See our Privacy Policy for details on how this data is handled.
We may update how this data is stored as the product develops.
6. Feedback
If you submit feedback, suggestions, ideas, or comments, you allow Attune to use them to improve the product without compensation or obligation to you.
Please do not submit confidential or sensitive information through the feedback form.
7. Initial Release Availability
Because Attune is in initial release, the app may contain bugs, interruptions, incomplete features, or content issues. We may change, suspend, or discontinue parts of the service at any time.
We are under no obligation to maintain, support, or continue the initial release service.
8. User Conduct
You agree not to:
Use Attune for unlawful purposes.
Attempt to access systems or data you are not authorized to access.
Interfere with the operation, security, or performance of the app.
Upload or submit harmful, abusive, misleading, or unlawful content.
Scrape, crawl, or systematically extract content from the app.
9. Third-Party Services
Attune may rely on third-party services for hosting, analytics, databases, content processing, and other app functionality. Your use of Attune may involve those services as described in our Privacy Policy.
10. Disclaimers
Attune is provided "as is" and "as available." We make no warranties, express or implied, regarding the app’s fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or secure, or that content recommendations will always meet your expectations.
11. Limitation of Liability
To the maximum extent permitted by law, Attune Labs LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of Attune.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.
If you have a dispute with us, we encourage you to contact us first at support@listentoattune.com so we can try to resolve it informally. If we are unable to resolve the dispute informally, it will be subject to the exclusive jurisdiction of the state and federal courts located in New York, New York, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and make reasonable efforts to notify you through the app or by email if you have provided one.
Your continued use of Attune after changes means you accept the updated Terms.
